In Türkiye, the right belongs to whoever files first.
Turkish trademark rights follow registration, not use. We run filing, opposition and infringement as one strategy.
Trademark filing and opposition
Similarity searches, class selection, filing and opposition to publication, together with invalidity actions against bad-faith registrations.
Patents, utility models and designs
Applications and annuity management, and detection and stopping of infringement once the right is granted.
Counterfeiting and infringement actions
Customs seizure applications, interim injunctions, recall of goods and claims for pecuniary and moral damages.
Licensing, assignment and franchising
Use agreements and the limits of brand use in distribution and franchise structures, recorded against the register where appropriate.
Common questions
My mark is registered at home. Is it protected in Türkiye?
As a rule, no. Trademark protection is territorial: protection in Türkiye requires a Turkish registration or an international registration designating Türkiye. Exceptions exist for well-known marks, but relying on them is risky.
Someone registered my mark before me. What now?
An invalidity action can be brought against a bad-faith registration, particularly where the other side had a commercial relationship with you or demonstrably knew of your mark. Time limits apply, so the moment you learn of it is the moment to act.
How long does registration take?
An unopposed application generally concludes within a matter of months; opposition extends the timeline. Because priority runs from the filing date, protection effectively begins while registration is still pending.
